COURT OF APPEALS AGREES WITH ATTORNEY TOMAS AND OVERTURNS FIRST DEGREE MURDER CONVICTION
Client Merchant was charged with First Degree Murder and Attempted First Degree Murder. After a week-long trial, and during the jury deliberation, the judge declared a mistrial and forced Merchant to go through another trial. Before the start of the second trial, Attorney Tomas filed a motion to dismiss on double jeopardy grounds. Trial court denied the motion and Merchant was taken to trial a second time. At the second trial, Merchant was convicted of first degree murder and acquitted of attempted first degree murder. He received a sentence of life in prison. Although the trial court denied Mr. Tomas's motion to dismiss, the Court of Appeals eventually agreed with Tomas and ordered that Merchant's conviction be vacated and that he be released and forever discharged from the crime. After almost ten years in jail, Merchant was set free and can never again be tried for this crime.
